Paternity Establishment for Unmarried Fathers
For unmarried fathers, establishing paternity is the foundational step. Under California law, an unmarried father has no legal right to custody or visitation until parentage is formally recognized, regardless of biological connection. Once paternity is established, you have the same right to seek custody and visitation as any married father, and your child may gain access to your health insurance, inheritance rights, and family medical history.
Paternity can be established two ways: both parents can sign a Declaration of Parentage and submit it to the State Department of Child Support Services, or either party can petition for a court-ordered DNA test. If you were married to your spouse at the time of your child’s birth, California Family Code Section 7540 conclusively presumes you are the legal father. Los Angeles County family courts handle paternity petitions, and the correct filing location depends on where the parties reside within the county.
A Father’s Legal Rights in California
California Family Code Section 3040 directs courts to award custody based on the child’s best interests without preference for either parent’s gender. Section 3011 identifies the factors courts weigh: the child’s health and safety, each parent’s history of involvement, and any history of abuse. Understanding these standards shapes how you present your case from the first filing.
Fathers who share legal custody have the right to participate in decisions about their child’s health, education, and religious upbringing. Child support, whether you owe it or are entitled to receive it, is calculated under the statewide guideline formula in Family Code Section 4055. When circumstances change materially, either parent can petition to modify custody or support. When court-ordered parenting time is denied, a father can file an Order to Show Cause seeking contempt remedies, which may include makeup parenting time or fines against the violating parent.
Fathers facing false allegations of abuse or domestic violence have the right to present evidence in response. California law also expressly prohibits a parent’s sexual orientation from being used as a factor in custody determinations.
