California’s Legal Requirements for Postnuptial Agreements

California Family Code section 1500 authorizes spouses to alter their statutory property rights through a written marital property agreement. That authorization comes with real conditions. Under Family Code section 721, spouses owe each other a duty of the highest good faith and fair dealing, which means full financial disclosure of assets, debts, and income is required before either party signs.

Changing the character of property requires specific formalities. Under Family Code section 852, a transmutation converting property from community to separate, or vice versa, must be made in writing with an express declaration accepted by the spouse whose interest is adversely affected. Oral agreements about property characterization aren’t enforceable in California. One notable difference from prenuptial agreements: there is no mandatory waiting period before a postnuptial agreement can be signed, unlike the seven-day requirement under Family Code section 1615 that applies to prenuptial agreements.

Because spouses are already in a fiduciary relationship when a postnuptial agreement is signed, California courts examine these agreements with greater scrutiny than prenuptial agreements. When an agreement significantly benefits one spouse, courts may presume that undue influence was at work, shifting the burden to the advantaged spouse to show the agreement was fair and entered voluntarily.
